Is her marriage to an Italian man who uttered the Two Testimonies (Shahadatayn), promised to gradually embrace Islam, and practiced some of its rituals, but does not pray, invalid? Should she divorce him despite his attachment to her, or should she continue to help him become a true Muslim?

For Islam to be established by uttering the Two Testimonies of Faith (Shahadatayn), this must be done with the intention of entering Islam and committing to its rulings, and not merely for informing or achieving a worldly purpose like marriage. This is because mere knowledge of or informing with the Two Testimonies does not constitute faith unless accompanied by submission and action.

Accordingly, the marriage of a Muslim woman to a disbeliever is not permissible, and sincere repentance and severing the relationship with him are obligatory. Marriage to him is not permissible unless he embraces Islam genuinely and establishes prayer (because abandoning it is disbelief). Then, the legitimate marriage contract (nikah) must be conducted with a guardian (wali) and two just witnesses.
