Is it permissible for a menstruating woman to pass the Miqat without consecrating herself in a state of Ihram if she intends to consecrate herself later from Jeddah, and should she consecrate herself from her place of residence in Jeddah or from the Miqat?

It is not permissible to enter into a state of ihram (definition) from beyond the miqat (definition) designated by the Prophet, peace and blessings be upon him. The miqat for the people of Najd is Qarn al-Manazil (As-Sail al-Kabeer). If a woman departs from her country intending to perform the rituals, she must enter into ihram from the miqat, and then remain in her state of ihram until she becomes pure from menstruation.

If she passes the miqat without entering into ihram, she must return to it to assume ihram. If she returns and enters into ihram, then there is nothing upon her. However, if she enters into ihram after passing the miqat, she must offer a compensatory sacrifice (dam) for neglecting an obligation, which is to enter into ihram from the miqat. This is the opinion of the majority of scholars.

The more accurate view is that if one passes the miqat and then returns to it without having entered into ihram, there is nothing upon him because he did not begin his ihram except from the miqat. However, if one passes the miqat without ihram, then enters into ihram and returns to the miqat while still in ihram, he must offer a compensatory sacrifice (dam) for having entered into ihram after the miqat.
