Abortion is permissible before forty days according to many jurists. However, between forty and one hundred and twenty days, it is not permissible except in cases of extreme necessity. Based on your ex-husband's intention to disown your son, it is permissible for you to have an abortion even after forty days, as long as it is before one hundred and twenty days, because the disownment of a child is a great harm to him. If the abortion is before forty days, it is even more preferable.
