Is it permissible for a husband to recant his oath of divorce after swearing to his wife that she should not go to her father's house, and is it permissible for him to offer expiation?

The majority of scholars hold that a divorce oath takes effect upon breaking it. This is the fatwa we adhere to. Therefore, if you go to your father's house, your divorce will take effect, and your husband can take you back if this divorce does not complete the three divorces.

Shaykh al-Islam Ibn Taymiyyah is of the view that the ruling on a divorce oath, when its intent is not to make divorce conditional but rather to threaten or emphasize, is similar to an oath by Allah. Thus, if the oath is broken, the one who swore it must offer an expiation for an oath, and no divorce takes place.

The permissible oath is to swear by Allah the Almighty. As for swearing by divorce, it is among the oaths of the wicked.
