Is the husband's angry statement to his wife, "By oath, you will not stay with me in the house and go to your family's house," considered a first divorce (talaq), even if there was no intention of divorce?

The phrase "Go to your parents' house" is one of the allusions to divorce, by which divorce does not occur unless intended. If he did not intend divorce, then it does not occur. Marital matters should not be dealt with impulsively and angrily. One should choose good words and not rush into uttering words of divorce. It is not permissible for a Muslim to swear by anyone other than Allah Almighty, or by His names and attributes, for the Prophet, peace and blessings be upon him, said: "Whoever swears an oath should swear by Allah or remain silent."
