If the driver breaches the contract, it is permissible to terminate the contract and his stay. However, taking money from him has no basis in Islamic law, especially if his refusal to work is due to an accident. The fundamental principle is the inviolability of a Muslim's wealth except by right, as Allah Almighty says: "And do not consume one another's wealth unjustly," and the Prophet, peace and blessings be upon him, said: "Every Muslim's blood, wealth, and honor are sacred to another Muslim." One who takes his Muslim brother's money is asked by what right he deems it lawful, as in the hadith prohibiting the sale of fruit before its ripeness: "Have you considered, if Allah withholds the fruit, by what right would you deem your brother's wealth lawful?"
