Is it permissible to divorce a breastfeeding woman?

It is permissible to divorce a breastfeeding woman if the husband divorces her during a period of purity in which he has not had intercourse with her. However, if he divorces her during menstruation or during a period of purity in which he has had intercourse with her, then this is an innovative divorce (talaq bid'ah) and is forbidden by scholarly consensus; based on the words of Allah the Almighty: (So divorce them for their prescribed periods), and based on the words of the Prophet, peace and blessings be upon him: (If he wishes, he may divorce before he touches her, for that is the prescribed period for which Allah has commanded women to be divorced).

If the breastfeeding woman does not menstruate due to breastfeeding, it is not permissible to divorce her if her husband has had intercourse with her during that period of purity until she menstruates and becomes pure, even if the period of waiting is long; because divorcing her during a period of purity in which he has had intercourse with her is considered an innovative divorce.
