Is it permissible to divorce a breastfeeding woman?
It is permissible to divorce a breastfeeding woman if the husband divorces her during a period of purity in which he has not had intercourse with her. However, if he divorces her during menstruation or during a period of purity in which he has had intercourse with her, then this is an innovative divorce (talaq bid'ah) and is forbidden by scholarly consensus; based on the words of Allah the Almighty: (So divorce them for their prescribed periods), and based on the words of the Prophet, peace and blessings be upon him: (If he wishes, he may divorce before he touches her, for that is the prescribed period for which Allah has commanded women to be divorced).
