What is the ruling on one of the heirs refusing to divide the inheritance and exploiting it for their own benefit, thereby depriving the remaining heirs of their rights?
It is not permissible for an heir to seize the inheritance and deprive the rest of the heirs of their right, as this is consuming people's wealth by false means. Whoever does this must repent to Allah and give the heirs their share. Let him know that Allah has warned those who transgress His limits concerning inheritance with severe torment. He must also compensate the heirs for the period he utilized the house by paying a fair market rent. If he does not respond, it is advisable to take the matter to the Sharia court to compel him by law, for Allah restrains through authority what He does not restrain through the Quran.
