How is the inheritance to be divided among: a father, a mother, three full brothers, one full sister, two uterine brothers, five full nephews, two full paternal uncles, and ten full paternal cousins?

If the heirs are limited to the parents only, then the parents inherit to the exclusion of others, and the siblings are excluded by the father. The mother receives one-sixth due to the presence of a group of siblings, and the remainder goes to the father by virtue of ta’sib (residuarily). The inheritance is divided into six shares: one share for the mother and five for the father. The father excludes the siblings from inheriting entirely (exclusion of deprivation). The majority of scholars hold that siblings reduce the mother’s share from one-third to one-sixth, even if they themselves are excluded. Inheritance cases must be referred to Sharia courts for precise investigation, as there may be other heirs, or wills, or debts that take precedence over the rights of the heirs.
