Is a woman, who has not been officially divorced from her husband after seven years of marriage and the cessation of conjugal relations and maintenance for one year, entitled to maintenance, a consolation gift, and other rights, especially since she is fifty-two years old and her menstruation stopped more than two years ago?

If the husband obtains a divorce document without uttering or writing divorce, but with the intention of effecting it, the divorce is not valid, and the wife is still under his marital bond.

The husband must provide for his wife unless she is disobedient (nashiz), and the maintenance for the past period is a debt upon him.

The husband must ensure his wife's chastity to the best of his ability and her need.

If the husband refrains from providing maintenance or is in financial hardship, the wife may refer the matter to court and request annulment.

If the husband divorces his wife and does not stipulate the forfeiture of her rights, she is entitled to her full dower, and to maintenance and housing during the waiting period (iddah), and mut'ah (compensatory gift) according to some scholars.

The waiting period (iddah) for a woman who has despaired of menstruation is three lunar months.

If a dispute arises between the spouses, the reference point is the Sharia court.
