It is not permissible for the mortgagee to spend the mortgaged money. The woman who spent the mortgaged money is transgressing and is liable for the amount. She should not be given from unless she repents and is unable to repay, in which case she may then be given as someone in debt. It is permissible for her husband to give her from his Zakat money to repay her debt.
