Is the tenant who leased an orphanage's land for a long period and at a predetermined price obligated to renew the contract or pay an additional amount, after the rise in the price per square foot of land and the subsequent increase in construction costs and fees, knowing that the contract was made with the consent of both parties and the legal consultant's opinion supports the tenant?

The harm inflicted upon the orphans due to the contract can be removed from three angles: First, according to some Shafi'is, leasing for more than one year is impermissible, thus the contract should be annulled. Second, according to the Hanafis, Ibn Hazm, and others, the lease contract is terminated upon the death of the lessor, if the contract was concluded by the deceased father of the orphans. Third, the guardian or the heirs' agent is liable if the contract was concluded with excessive unfairness, especially with the annual increase in rents. We advise the tenant to cease adherence to the contract, to avoid dispute and out of mercy for the orphans.
