What is the ruling on a Khul' divorce that occurred under duress upon the husband and without the wife's consent, and is it permissible for the wife to marry another man after this Khul'?
It is not possible to issue a (religious edict) regarding this matter without clarification, and it is preferable to refer to the court or consult scholars directly. The mother or the wife's family do not have the right to force the wife to demand a divorce, or to force the husband to divorce for any reason other than a legitimate one. If the husband divorces his wife due to coercion that is considered legitimate according to Sharia, such as fear of unjust imprisonment, then his divorce does not take effect according to the majority of scholars. The ruling on the validity of a divorced woman's marriage to another man depends on whether the divorce occurred or not, based on the consideration of coercion. Therefore, the importance of consulting the Sharia court or scholars directly is emphasized.
