Is a woman considered Islamically divorced from her husband who was imprisoned and deported from the country, and he neither verbally nor officially divorced her, and he refused to reunite or find a solution to her problem with the children, especially after he blackmailed and threatened her, and agreed to marry another woman?

If the husband did not utter the divorce and wrote it on a paper without the intention of effecting it, the wife remains under his marital bond. It is advised to strive for family reunification and to fulfill mutual rights. If this is not possible, or if the husband falls short, the wife may request a divorce to avert harm. If the husband does not respond, she should refer the matter to the Sharia (definition) judge. The children's maintenance is obligatory upon the father if he possesses the means to spend on them and they are in need of it.
