Did the Prophet (peace be upon him) have the authority to make the use of siwak obligatory upon the Ummah?
The hadiths indicate that the Prophet, may Allah bless him and grant him peace, did not make the use of the siwak obligatory for his Ummah out of fear of burdening them. An obligation in Islamic law is established by a text from the words of Allah Almighty, or by revelation sent down to the Prophet, may Allah bless him and grant him peace, and it can also be through the Prophet's own (independent reasoning).
Just as he did not make the siwak obligatory for them out of fear of burdening them, he also refrained from coming out to them for the Night Prayer () out of fear that it might be made obligatory for them. Thus, his compassion and mercy for them, may Allah bless him and grant him peace, were the reasons for its non-obligatory status.
