The general rule is that custody belongs to the mother when the spouses separate, unless there is an impediment. Among the impediments to custody is immorality (fisq). If the mother's immorality is proven, her right to custody is forfeited according to many scholars. Issues of custody in cases of dispute are referred to the judge for resolution. It is incumbent upon the husband to uphold his responsibility of guardianship over his wife and protect her from tribulations.
