What is the ruling on borrowing from someone's deposit without their knowledge, knowing that if they request their money, gold will be sold to complete it and give them their full right?
It is permissible to borrow from a deposit without the owner's permission if the depositor knows, with a certainty that reassures his heart, that the owner of the money is content with that. This is known through complete experience and knowledge of the depositor's standing with him. Such an action has been reported from more than one person, just as the Prophet, peace be upon him, used to do in the homes of some of his companions, and just as he pledged allegiance on behalf of Uthman, may Allah be pleased with him, while he was absent. However, if there is any doubt about this, borrowing is not permissible.
