The answer

Homosexuality is a deviation from the natural human disposition (fitra) and is considered one of the gravest sins. Its perpetrator deserves to be killed. However, the implementation of hudud (punishments prescribed by Islamic law) is entrusted to the ruler or his deputy, after clear evidence is established. The questioner is not permitted to kill him on his own. If the crime is not proven, the questioner should be patient and try to forget it. Allah Almighty will punish the oppressor in this world and the hereafter. Furthermore, the questioner should ascertain his certainty regarding the assault, especially since he was asleep and the perpetrator swore an oath on the Quran.
