What is the ruling on someone who committed murder while intoxicated?

The soul and the intellect are among the universals of Islam, and aggression against them is considered one of the greatest sins. Whoever kills while intentionally drunk has committed two crimes by assaulting the soul and the intellect. His punishment is retaliation (qisas) unless the guardian of the victim pardons him. This is the view of the majority of scholars, and the one who carries out qisas is the ruler or his representative.
