The fundamental principle regarding oaths is that they must be sworn by Allah Almighty or by one of His attributes. It is not permissible to swear by anything else, such as divorce or other things. Al-Tirmidhi narrated from Ibn Umar, may Allah be pleased with them both, that the Prophet, peace and blessings be upon him, said: "Whoever swears by other than Allah has committed polytheism."
