What is the ruling on an oath that contradicts one's intention?

The decisive factor in an oath is the intention of the swearer, if he intends what his words can convey. This is based on the saying of the Prophet (peace be upon him): "Indeed, actions are by intentions, and indeed, every person will have what he intended."

Thus, the intention of the swearer particularizes his oath and restricts it. This is the view of the majority of scholars.

However, if a right of another person is attached to the oath, or if a judge administers the oath, then the intention belongs to the one who administers the oath, based on the saying of the Prophet (peace be upon him): "The oath is according to the intention of the one who administers it."
