A deposit is a gratuitous agency for safekeeping. For a deposit to be valid, the same conditions as for agency apply, namely maturity, sanity, and sound judgment. It is recommended to accept a deposit for someone confident in their ability to safeguard it, and discouraged for someone unable to do so. A deposit is a trust; if it is damaged while in the depositee's possession without negligence on their part, they are not liable for it. However, they are liable if they transgress against it or are negligent in its safekeeping. The depositee must keep the deposit in a secure place appropriate for it. If it is an animal, they are obliged to feed it. The depositee may entrust the deposit to someone who customarily safeguards their property, such as their spouse or servant.
