What must a husband do to complete the expiation for Thihar after having intercourse with his wife during the two consecutive months of fasting that are obligatory upon him, and what is the ruling on the days he has already fasted?

Two explicit divorces have occurred, counting towards the three, and the husband now has only one divorce remaining. As for the husband's statement to his wife, "You are to me like my mother," this is a phrase that can imply ẓihār (a form of divorce by injurious assimilation) or other meanings. It is not considered ẓihār unless accompanied by the intention. If he intended it as ẓihār, then it is ẓihār, and expiation (kaffārah) is obligatory. He is not permitted to approach her before performing the expiation. He must seek forgiveness for the intercourse that occurred before the expiation, and he must recommence the expiation by fasting. However, if he did not intend ẓihār by it, then there is nothing incumbent upon him, and no expiation is required.
