A wife must obey her husband in intimacy, except if there is a legitimate excuse, such as if the disease afflicting the husband is contagious and the wife fears its transmission to her, or if it is repulsive, causing the wife unbearable harm that is not ordinarily tolerable. In such cases, the wife is excused for her refusal and is not considered disobedient (nashiz). The husband then has the choice to divorce her, keep her and endure, or marry another. However, if the disease is not contagious and does not ordinarily cause aversion, she has no excuse for refusal and is considered disobedient (nashiz), forfeiting her right to maintenance. The determination of whether a disease is contagious or repulsive is referred to the opinion of medical professionals.
