Is it permissible for a participant in a soap-making workshop to demand a full refund of his capital before selling the products, knowing that the goods are susceptible to spoilage and there is stagnation in marketing?

According to the majority of jurists, a partnership (sharika) is a permissible contract (aqd ja'iz), allowing either partner to dissolve it. However, according to the Malikis, it is a binding contract (aqd lazim) that cannot be dissolved except with the consent of the other party, or until the capital matures, or the work is completed. The right to dissolve does not mean that one partner can unilaterally appropriate the capital; rather, it is a cessation of the company's activity, after which the partners share in its assets according to their respective shares, and they may divide or sell the assets. Dissolution should not cause harm to either partner, and if it entails harm, it is impermissible unless the harm can be remedied by a guarantee.
