Disputed matters between spouses are to be referred to the Sharia court, or to someone both spouses agree upon to arbitrate between them. It is obligatory for spouses to live together amicably. The wife has the right to maintenance for herself and her children. If the husband fails to provide maintenance, she has the right to refer the matter to the judiciary to rule on annulment or divorce. Ibn Qudamah said: "If he withholds it, and she finds nothing to take, and she chooses to separate from him, the judge shall separate them... So the woman is given a choice between enduring him and separating from him."
