Is the mother's deferred Mahr considered a debt owed by the deceased father, requiring repayment on his behalf, or is there another way to settle this debt?
The deferred Mahr (dowry) is a debt owed by the husband and must be paid unless the wife willingly relinquishes it, as Allah Almighty says: "And give women their Mahr as a free gift. But if they willingly give up to you anything of it, then take it as lawful and pleasant." If the husband dies before paying it, it is to be taken from his estate after his burial preparations and before the execution of his will. This does not affect the wife's share of the inheritance. It is obligatory to hasten the payment of this debt and other debts of the deceased, as the Prophet, peace and blessings be upon him, said: "The soul of a believer is tied to his debt until it is paid off." The deferred Mahr is paid to the wife if she is alive and has not relinquished it, or to her heirs if she has passed away.
