What is the ruling on a wife seeking divorce because she objects to her husband marrying another woman for the purpose of procreation, and what are her legitimate Shar'i rights if she insists on this, and would giving her her full deferred mahr, gold, and trousseau, along with an additional 5,000 pounds, be considered an injustice to her?

A wife does not have the right to demand a divorce merely because her husband married another woman, as Al-Dardir Al-Maliki stated that it is not permissible for her to seek divorce for such a reason. The Prophet, peace and blessings be upon him, warned the woman who seeks a divorce without a valid justification that she would be deprived of the scent of Paradise.

However, if the wife cannot bear to remain with the husband after he marries another, she may seek a khul’ (dissolution of marriage) from him in return for her mahr or a portion of it.

Therefore, as long as the wife is asking for a divorce without harm, the husband has the right to refuse divorcing her until she relinquishes her mahr or a portion of it. There is no objection to reaching a mutual agreement on any form of khul’.
