A woman is not permitted to give herself or another woman in marriage, based on the Prophet’s (peace be upon him) saying: “A woman may not give another woman in marriage, nor may she give herself in marriage.” And according to his saying: “There is no marriage except with a guardian,” and “Any woman who marries herself without the permission of her guardian, her marriage is invalid.”

The father is the most entitled person to give his daughter in marriage, even if he is absent in another country. If the father refuses to give her in marriage, her guardianship transfers to the judge.
