What is the ruling on retracting a divorce oath after having sworn it upon one's wife and children not to go to the club?

1 min readAlso available in العربية

If someone swears by divorce concerning a future matter, such as his family going to the club, then his divorce takes effect if the condition is met. This is the opinion of the majority of scholars, and there is no difference whether he intended divorce or intended prevention and threat. Some scholars are of the view that if he did not intend divorce but rather intended a threat, then divorce does not occur, and he must offer an expiation for a broken oath (kaffarat yamin). The prevalent and more cautious opinion is the former; therefore, the swearer must prevent his family from going to avoid the occurrence of divorce, and he cannot retract this oath.
