The questioner must repent to Allah and abstain from smoking because it is forbidden. If the questioner’s intention was to swear off smoking, an oath is only binding when made by Allah’s names and attributes. Swearing by other than Allah is forbidden, as the Prophet (peace be upon him) said: "Whoever takes an oath, let him swear by Allah or remain silent," and his saying: "Whoever swears by anything other than Allah has committed Shirk." No consequence results from this oath because it is an act of forbidding something that is already forbidden. The questioner must offer sincere repentance, quit smoking, and avoid swearing by other than Allah. There is no specific expiation required of him; rather, he should increase in supererogatory acts of worship and good deeds.
