A husband's statement to his wife, "Then you are divorced," is considered an explicit and effective divorce. The divorce takes place even if the husband is angry, as long as he is aware of what he is saying. It is not a condition for the wife to hear the pronouncement of divorce for it to occur. Accordingly, if the husband divorces his wife three separate times, the wife becomes irrevocably divorced (bainunah kubra), and he is not permitted to remarry her unless she marries another man out of genuine desire (not a tahlil marriage) and he then divorces her after consummation or dies, and her ' (waiting period) expires. A tahlil marriage is void unless the intention of tahlil is solely on the part of the woman; however, if the husband's intention is tahlil, the contract is void.
