Is a woman considered to have initiated a divorce (khulʿ) or is she observing the waiting period (ʿiddat al-wafāt) for her husband who passed away, while she is living with another man, after she had sought a divorce (khulʿ) but her husband did not agree?

For a wife whose husband has passed away — and who was disobedient and opposed to a request for divorce (khul') — her 'iddah (waiting period) for widowhood is four months and ten days. She has a right to his inheritance and must sincerely repent for her disobedience, recalcitrance, and her relationship with a non-mahram man. She observes her 'iddah in her husband's home or in any permissible place, and she must absolutely sever her connection with the non-mahram man, because a relationship, seclusion, or physical contact between a woman and a non-mahram man is not permissible.
