Is a wife's saying to her husband, "I am divorcing you," as legally and religiously binding as a husband's saying to his wife, "You are divorced"? What is the ruling on concealing a physical defect for the purpose of marriage? And what should a husband do when he dislikes his wife and wishes to divorce her but does not possess the deferred dowry?

Every defect that affects marital life must be disclosed, and whoever conceals it is sinful. The other party has the right to annul the marriage and reclaim the mahr (dowry) if he is the husband, or not to pay it if it has not yet been paid.

However, if the husband accepts the defects after discovering them, his right to annulment is forfeited.

As for the wife's statement, "I divorce you through khul," it has no legal effect, as khul is solely in the husband's hands.

The deferred mahr must be paid in full, unless the wife voluntarily waives it. If the husband is unable to fulfill this, he must be patient or reach an understanding with her.
