Is it permissible for a father to take a portion of the monthly salary allocated for his orphaned children and their siblings without their knowledge of the amount taken, while giving the remainder to their mother due to her guardianship over them, or must they be informed?

The pension of a deceased person falls into three categories:

1. A salary due to the deceased (end of service or savings): This is considered an inheritance and is distributed among the heirs according to Islamic law. It is not permissible for an heir to distribute the inheritance himself without referring to a distributor or a ruler. You may distribute the salary only if your mother (the guardian of your siblings) agrees to appoint you as the distributor.

2. A salary given as a grant from the employer: This goes to those designated by the granting authority. If you are not among the designated beneficiaries, it is not permissible for you to take anything from it, even with the consent of the heirs or the guardian, because a minor's gift is not permissible and a guardian cannot donate the property of minors. If the authority does not specify beneficiaries, it is divided as the deceased's inheritance.

3. A mixed salary (due and grant): What was due is inherited, and what was a grant goes to those designated by the granting authority.

Based on this, it is not permissible for you to take anything from the salary without your mother's knowledge if it is an inheritance, and it is not permissible for you to take it at all if the granting authority has designated beneficiaries who do not include you.
