Is it permissible for the divorced woman's father to take the orphans' allowance, which was decreed by the Sheikh, under the pretext that he is the one who spends on them and houses them in his home, knowing that what he spends is much less than the amount of the allowance?

The father has no right to the property of his deceased son's children, nor does he have guardianship over them, unless their father appointed him or the ruler assumes that responsibility. The father has the right to demand rent for the children's lodging in his house if he is not offering it gratuitously.
