What is the ruling on subscribing to the Jumia platform for selling products, knowing that the platform's penalties, including financial fines, are predetermined and known to the seller in advance in case of violating the terms?

It is permissible to subscribe to the Jumia platform and adhere to its conditions to avoid financial penalties, for the penalty is not usury, but rather a discretionary punishment (ta'zir). Ta'zir involving money is prohibited according to the majority of scholars, while some permit it only for the ruler (wali al-amr) and the judge. If the seller can avoid the penalty by adhering to fair conditions, then there is no harm in it due to the benefit it entails. This is supported by the Prophet's (peace be upon him) narration to Aisha in the story of Barirah, where he permitted her to accept a void condition because it was not binding.
