Is it valid for the girl's paternal cousin to be her guardian in marriage (wali) in the absence of her brother, the death of her father, and the non-existence of other relatives?

A uterine brother has no guardianship (wilayah) over his sister in marriage, because he is not among her 'asabat (agnates), and marriage guardianship belongs only to the 'asabat. However, some scholars have validated a marriage contracted by a non-compulsory guardian, provided consummation has occurred and a long time has passed.
