Is it permissible to act upon the opinion of Sheikh Al-Albani regarding the permissibility of swallowing food for one who is caught by dawn while it is in their mouth, based on the premise that this is an exception to the saying of the Almighty: "And eat and drink until the white thread of dawn becomes distinct to you from the black thread," and that it does not contradict the Hadith: "If any of you hears the call to prayer and the vessel is in his hand, let him not put it down until he fulfills his need from it?"

The opinion that eating and drinking are permissible during or after the Fajr adhan is a weak opinion. Although Sheikh Al-Albani supported it, the hadith he relied upon, which states, "If one of you hears the call to prayer and the vessel is in his hand, let him not put it down until he has satisfied his need from it," is interpreted as referring to the first call for Fajr before the time for Fajr begins, or to doubt regarding the breaking of dawn. The texts are clear about the impermissibility of eating and drinking after dawn becomes clear, as in the Almighty's saying: "And eat and drink until the white thread of dawn becomes distinct to you from the black thread [of night]." The view of the majority, which is the basis of the fatwa, is that whoever eats or drinks intentionally after the breaking of dawn has invalidated his fast. However, the other opinion has some merit, and there is no blame on whoever adopts it by way of emulation of those who hold it, or out of necessity.
