The question

Is it permissible to tell the girl's family the truth despite her refusal, fearing for them, or should you leave her after she undergoes an operation, and would your marriage be lawful if I were to marry you and she is a previously married woman (thayyib) without a guardian (wali)?

The answer

The questioners must repent to Allah from adultery and abortion. If the image of the fetus is clear, then those responsible for the abortion must pay a blood money (diyya) to be distributed among the heirs of the fetus, excluding those responsible. Additionally, each of them must offer an expiation (kaffara) by freeing a slave; if unable to do so, then by fasting for two consecutive months. If no one else participated in the abortion, then the blood money is solely her responsibility. The man must distance himself from the woman because the marriage contract is invalid without a guardian (wali). She can be proposed to and married with her guardian's consent.
