Is it permissible for an heir to waive their right to an inheritance if they have children?

1 min readAlso available in العربية

If one of the heirs, being an adult, of sound mind, not coerced, and in full health, relinquishes their share of the inheritance, then their relinquishment is valid and effective and is considered a gift.

It is better for the heir to take their rightful share of the inheritance if they are in need of it for their own expenses or the expenses of their children, for the Prophet, peace and blessings be upon him, said: "The best charity is that which is given when one is rich, and begin with those whom you support."

However, if the heir is wealthy and not in need of the money, then their relinquishment is considered an act of charity and maintaining kinship ties.
