Is the wife considered legally a wife despite the passage of more than a month of marriage without consummation due to the husband's inability to achieve an erection and his ill-treatment of her? For how long can the wife be allowed to remain with him? Do her family have the right to request a divorce, and what are the consequent rulings?

If a husband is unable to have intercourse with his wife, his marriage is valid. The wife has the right to request annulment if the impotence is proven and she does not consent to it. If the period allotted for the husband's treatment passes, and the impotence does not go away, and the marriage is annulled, she must observe the waiting period ('iddah) and is entitled to the stipulated dower (sadaq), because she allowed him to be alone with her and gave herself to him. According to the Shafi'i school, she is not entitled to any dower, nor is she required to observe any waiting period. The husband does not have the right of return (raja'ah) in this case, and the husband must treat his wife well.
