Is it permissible for children to go with their mother after her divorce from their ill-tempered father? And is it permissible for them to travel to a foreign country to seek asylum without their father's knowledge in the event of a lack of financial support? And does the father have the right to be angry at their actions, knowing that their ages are (6, 9, 14, 15) and that one of them is contemplating suicide?
Firstly: Custody of children after divorce belongs to the mother for those under seven years of age, unless she remarries. As for those who have reached the age of seven: the boy is given the choice between his parents, and the girl is given the choice according to Al-Shafi'i, while Abu Hanifa and Malik believe the mother has more right to her until she marries, and Ahmad believes the father has more right to her.
Secondly: The children's maintenance is obligatory upon the father even if they are in the mother's custody. This maintenance continues for adults if they are poor, according to the Hanbalis, while Abu Hanifa and Malik believe that maintenance ceases for a boy if he reaches puberty and is healthy. For a girl, it does not cease unless she marries.
Thirdly: Custody ends when the child reaches puberty and maturity. At that point, the child has the choice to reside with whomever they wish, and a male can live independently. As for a female, her father has the right to prevent her from living independently for fear of corruption. It is not permissible for girls to travel or live independently from their parents, even if they are adult and mature. Adult females can travel with their mother, but non-adult females cannot travel with their mother except with the consent of the one who has custody rights after the mother.
Fourthly: The believer must be patient and content with Allah's decree, for life is full of trials, and with hardship comes ease. Suicide is forbidden by Islamic law and is a path to losing both this world and the hereafter; because the soul belongs to Allah Almighty, and it is not permissible to dispose of it except as permitted by Islamic law.
