If the husband's mother caused the death of the newborn through negligence or transgression, then expiation is obligatory upon her, and the mitigated blood money for the newborn is obligatory upon her 'Aqila (paternal kin), because her ruling is that of one who kills by mistake. Allah Almighty says: (And it is not for a believer to kill a believer except by mistake. And whoever kills a believer by mistake – then freeing a believing slave and blood money surrendered to his family unless they [charitably] forgo it). The blood money is mitigated upon the 'Aqila, who are the paternal relatives of the killer. The blood money is waived if the heirs of the newborn forgive it. It is necessary to consult doctors to confirm her causation of the death. The expiation is fasting for two consecutive months. It is permissible for one of her guardians to fast on her behalf after her death, according to the saying of the Prophet, peace and blessings of Allah be upon him: "Whoever dies and has [obligatory] fasting due upon him, his guardian should fast on his behalf."
