Is it permissible to take out a loan with interest from a bank to pay off an obligatory debt in order to avoid imprisonment?
Usury is one of the gravest sins, and Allah has informed us that the usurer is at war with Allah and His Messenger. The Prophet (peace and blessings be upon him) cursed the one who consumes usury, the one who feeds it, its scribe, and its two witnesses. Whoever deals with a usurious bank and takes out loans with interest has fallen into forbidden usury. He must hasten to repent to Allah, because fear of imprisonment is not an excuse for committing this unlawful act. The questioner must repent sincerely and submit his affair to Allah, and perhaps Allah will provide him a way out. The creditors should know that Allah said concerning the one in hardship: (And if there is any debtor in difficulty, then grant him time till it is easy for him to repay, and that you remit it as charity will be better for you if you only know) [Quran 2:280]. So, they should forgive him or wait for him until his situation becomes easy.
