How can the continuity of marital life be preserved after the husband said to his wife: "Do not address me with anything unless I address you with its like; if I do not, then you are thrice divorced," and the wife responded by saying: "You are thrice irrevocably divorced, whether he addresses her with divorce and she becomes divorced, or he does not address her and she becomes divorced"?

This issue has been mentioned in the books of some scholars. In "Matalib Uli An-Nuha" by Ar-Ruhaibani, Ibn Jarir al-Tabari issued a fatwa that divorce does not occur if the husband suspends it by saying to his wife: "You are triply divorced if I divorce you." He told the husband: "Go forth and do not repeat oaths after you say to her: 'You are triply divorced if I divorce you.' For you would have addressed her with the like of her address to you, thus fulfilling your oath, and she would not be divorced from you, due to the condition you linked the divorce with." Some scholars also held that if the husband's intention was merely to repel the insult, then he is not obliged to respond with such a phrase. One should be wary of over-complicating questions and asking about what is not beneficial, for that is blameworthy in Islamic law and wastes the time of both the questioner and the one being asked. The Messenger of Allah (peace and blessings be upon him) said: "Leave me as I leave you, for verily, those who were before you were destroyed due to their excessive questioning and their differing with their prophets. So, if I command you to do something, do of it as much as you are able, and if I forbid you from something, then abandon it."
