Does a divorce take effect by the husband's saying: "You are divorced, divorced, divorced, divorced by three, divorced by a million," if it has been ruled that it is a single divorce and he relies on the number of repetitions?
We have warned about the husband's laxity in uttering divorce and the danger of that. Regarding the husband's statement: "You are divorced, divorced, and so on," scholars have differed on its implications. The majority of scholars hold that it results in a triple divorce, and this is the fatwa we issue. Based on this, the wife is considered a stranger to him, their relationship is forbidden, and she is not lawful for him until she marries another husband in a marriage of desire, and then he divorces her after consummation.
However, Sheikh al-Islam Ibn Taymiyyah and those who agreed with him held that it counts as a single divorce. The husband may follow this opinion if he trusts the knowledge and piety of its proponent.
The following implications arise from this: 1. If the husband does not reconcile with his wife before she gives birth, a minor separation occurs. She is not lawful for him except through a new marriage contract, provided this divorce does not complete the three divorces. If it is the third divorce, she is not lawful for him until after she marries another husband. 2. If reconciliation occurs before the completion of the waiting period, and this divorce does not complete the three divorces, the wife returns to his marital bond. Nothing is incumbent upon him regarding his statement "haram" (forbidden) if he intended what was mentioned and did not intend to make his wife forbidden, because an absolute prohibition that is not intended to make the wife forbidden is considered null and void by many scholars.
