If the deceased leaves behind only a husband and children, the husband receives one-fourth due to the existence of a inheriting descendant. The remainder goes to the children by way of ta'sib (agnatic inheritance), with the male receiving the share of two females. The other heirs mentioned are excluded by the son, an exclusion of deprivation (hajb hirman). The estate is divided into 28 shares: the husband receives seven shares, each son receives six shares, and each daughter receives three shares. It is obligatory to refer inheritance matters to the courts for investigation regarding the presence of wills, debts, or other rights that take precedence over the rights of the heirs.
