Is the prayer of a congregant who believes the Imam takes responsibility for reciting the Fatiha, but delays its completion as a precaution until the Imam rises from bowing, invalidated?

If the 遅れた (late-comer) behind the Imam misses the bowing (ruku') with the Imam until the Imam has risen from it, he has then fallen behind the Imam by one pillar without an excuse. The Hanbalis consider that this delay invalidates the prayer if it occurs during the bowing. The Malikis, however, differentiate between this delay occurring in the first rak'ah for the late-comer or in others; they invalidate the prayer if the delay occurs in the first rak'ah without an excuse, but do not invalidate it if it occurs in other rak'ahs. If the late-comer follows these jurists (muqallid), his prayer would be invalidated according to the differing opinions between the Malikis and Hanbalis regarding rak'ahs other than the first. However, if it becomes clear to him that the opinion of the prayer's validity is stronger in evidence, or if he seeks a fatwa from someone he trusts and is given a fatwa of validity, then he may adopt that.
