Scholars have unanimously agreed that whoever intentionally destroys a human being or a part thereof is liable to qisas (retribution), arsh (compensation for injury), or diyah (blood money). An unintentional act does not negate the liability, but the aqilah (male relatives on the father's side) bears the responsibility. The value of arsh for organs varies according to the organ's benefit and the extent of the injury. If a court rules a specific amount, no other diyah or arsh can be determined unless the matter is referred to a Sharia court if the existing court is not one. A reconciliation between the victim and the perpetrator is permissible for any amount they mutually agree upon, but the perpetrator cannot be compelled to pay more than what is Islamically due from him without his consent.
